Countyhas10criminaldistrictcourtsand15countycourts.Thecountyhasadistrictcourtandcounty
courtindigentdefenseplan.

BexarCountyalsohasseveralspecialtycourts.BexarCountycurrentlyhas
acourt‐appointedattorneywheelsystemandaPublicDefenderOfficetorepresentindigentclients.The
PublicDefenderOfficeismadeupofthefollowingdivisions:appellate,misdemeanorandfelonymental
health,mentalhealthcivil,misdemeanortrial(onlyoperatesincourtswherejudgeselecttohavethe
PublicDefender)andmagistration.ThecurrentstudyfocusedonBexarCounty’sadultindigentdefense
system.
InAugust2010,theTaskForceonIndigentDefense,nowknownastheTexasIndigentDefense
Commission,publisheda“ReviewofBexarCounty’sIndigentDefenseSystems,”afullassessmentofthe
indigentdefensesysteminthecounty.Thisreportfoundissueswithtimelyappointmentofcounseland
appointmentproceduresdeviatingfromtheapprovedindigentdefenseplan.

Afollow‐upvisittoBexar
Countyin2012showedmanyoftheissuesfoundin2010hadbeenresolvedandwereincompliance
withTIDCrecommendationsfromthe2010review.
BexarCountyisoneoftheleadersinthestatebyprovidingcounselatmagistration.Onlyfour(Bexar,
Cameron,FortBend,andHarris)countiesoutof254offercounselatmagistration(alsoknownasfirst
appearance).TheBexarCountyPublicDefenderOfficerepresentsdefendantsatmagistration.According
totheTexasIndigentDefenseCommission’sinnovationbrief

,a150%increaseoccurredindefendants
releasedonpersonalbonds.Additionally,mentalhealthpersonalbondsincreased20%inclients
representedbytheBexarCountyPublicDefenderOffice.
ComparisonoftheBexarCountyIndigentDefenseSystemtoPeerCounties
ThelargestcountiesinTexasareleadersininnovativepracticesforindigentdefensesystems.As
previouslymentioned,BexarCountyiscurrentlyoneoftheleadersinthestatebyprovidingcounselat
magistrationandhavingmultiplespecialtycourts.ThecountyhasaRemoteAttorneyVisitation(RAV)
systemandavoucherrecommendationcommittee,whicharebothinnovativeandpromisingpractices.
Eachoftheseinnovationswillbediscussedinlaterchapters.
HarrisCountyisaleaderinthestatebyalsoprovidingcounselatmagistration.HarrisCountyisinthe
processofimplementingaMACofficewithsupportfromaTIDCgrantandhasapublicdefenderoffice
whichhandlesmisdemeanor,felony,juvenile,andappellatecases.TravisCountyisalsointheprocessof
implementingacounty‐widepublicdefenderofficewithsupportfromaTIDCgrant.DallasCountyalso
hasapublicdefenderoffice,whichrepresentsmisdemeanor,felony,juvenile,andappellatecases.

NotlaterthanNovember1ofeachodd‐numberedyear,everycountyismandatedbytheTexasLegislatureto
submittotheTexasIndigentDefenseCommission(TIDC):(1)acopyofitscountywideindigentplan(s)and
proceduresandanyrevisionstotheplanorformspreviouslysubmitted;or(2)averificationthattheplanand
formspreviouslysubmittedstillremainineffect.Theseinstructionsgovernthesubmissionoftheplansduetobe
submittedtotheTIDC,pursuanttoSection79.036oftheTexasGovernmentCode.BexarCounty’sindigent
